Driver’s License and Bankruptcy

For many people it is imperative to have a driver’s license to get back and forth to work. If you can’t work, then generally you can’t pay your debts. The loss of a driver’s license can present a huge hardship if you’ve been in an accident and you have lost your license because you didn’t have insurance. For instance, if you are in an automobile accident and you didn’t have insurance on your vehicle, and it was your fault. The other car was damaged, or the other person was hurt, and the other party’s insurance company filed the necessary forms with the State of Alabama to suspend your driver’s license. How are you going to get to work if you don’t have a car? If you can’t drive back and forth to work, you will likely to lose your job! For instance, if you’ve lost your license due to excessive traffic tickets then these debts cannot be eliminated through either a Chapter 7 bankruptcy or Chapter 13 debt consolidation.

However, by filing a Chapter 7 or Chapter 13 then you may be able to free up enough income to allow you to start paying the traffic fines. A regular payment to the court may allow them to release your license.

In you have had a car wreck and lost your license, you can look at two options. The first option is to consider a Chapter 7. This will eliminate that debt within 3 to 4 months and will also eliminate any other unsecured debt that you have. At the time of filing the Chapter 7 petition, you may take the petition to the Department of Public Safety. This will allow the suspension on your license to be removed. A Chapter 13 will also have the exact same effect upon the filing of the Chapter 13 petition. Once we file the petition and you receive a case number you may take it to the Department of Public Safety and show them that you are involved in a Chapter 13. Next, you will have to go to your local driver’s license office to get a new license. Getting your driver’s license back through a Chapter 7 bankruptcy or Chapter 13 debt consolidation can be tricky.
