Drug Related Offenses

It is impossible to write about all of the Alabama drug related offenses in a few short paragraphs because there are so many offenses. Alabama has drug related charges ranging from severe, such as Trafficking in drugs, to misdemeanors such as Possession of Marijuana 2nd. However, if you are facing any drug related offense you can be imprisoned for a minimum of one year. Other sentences can range up to life in prison. The following are some examples of common drug related offenses and the punishments. The punishments listed below are based on the defendant not having any prior convictions.

Possession of Marijuana 2nd

  • Imprisonment up to one year in prison
  • Fine up to $6000
  • Loss of driving privileges for up to six months
  • Conviction of Possession of Marijuana 2nd is a Class A Misdemeanor

Possession of Marijuana 1st

  • Imprisonment from one year and one day to ten years
  • Fine up to $15,000
  • Loss of driving privileges for six months
  • FELONY (Class C)

Uniform Possession of a Controlled Substance (UPCS)

  • Examples of (UPCS) are cocaine, crack, meth,ecstasy, or a non-prescribed pain medication such as Hydrocodone, Lortab, or Oxycodone
  • Imprisonment from one year and one day to ten years
  • Fine up to $15,000
  • Loss of driving privileges for six months
  • FELONY (Class C)

Drug Trafficking

  • Depending on the drug and amount, imprisonment ranges from three years to life in prison with no chance of parole!
  • Fine up to $50,000
  • FELONY (Class A or B)

Possession of Drug Paraphernalia

  • Imprisonment up to one year
  • Fine up to $6000
  • Loss of driving privileges for six months
  • Conviction of a Class A misdemeanor

However, if the defendant does not complete the program, the original agreed upon sentence is imposed.
