A conviction will result in the loss of your driver’s license, costs, fines and possible jail time. Under Alabama law, your first DUI conviction can result in:

• Imprisonment of up to one year
• Suspension of your driver’s license for 90 days
• Fines between $600 and $2,100
• Must complete court referral program.
• Convictions stay on your driving record for 5 years

Having a prior DUI and being charged for a second or third time can have even greater consequences. Also, if you receive a fourth DUI within 5 years, it is a felony and you could be imprisoned from up to one year and one day to ten years! For example, a second DUI within 5 years carries the following punishment

• Imprisonment from 48 hours to 1 year and not less than 70 hours of community service
• Fines between $1000 to $5000
• Loss of license for 1 year
• Must complete court referral program
• Convictions stay on your driving record for 5 years

A third DUI within 5 years carries the following punishment

• Imprisonment between 60 days to 1 year
• Loss of license for 3 years
• Must complete court referral program
• Fines between $2000 and $10,000
• (Other punishment as stated above)

Alabama has a point system in place which is designed to keep up with the points assigned to individual drivers for different violations. This system helps determine the length of a license suspension period and is also used to punish drivers who continue to break the law while operating on Alabama’s roadways.
